Nifong, stripped of his law license by the North Carolina State Bar for his handling of the case, listed debt of $180.3 million and assets of $243,898 in documents filed today in U.S. Bankruptcy Court in Durham, North Carolina. He resigned from his post as Durham County District Attorney in July.

The $180 million includes outstanding claims in lawsuits filed against him.

Not sure which board this belongs on now; mods, feel free to move.

I was hoping someone would post this, didn't have time earlier.

Is he allowed to claim outstanding claims in lawsuits that aren't settled? Also, is this a preemptive move on his part so he doesn't lose his home?

He is very definitely allowed to list unfinalized claims against him.

This isn't a big deal with respect to the claims against him in that the 3 were certainly counting on the government to have the deep pockets to cover any judgment anyway.

Uh oh... too bad, so sad!

But I don't understand the federal part... how can the Duke 3 bring a federal case against him? Or are they trying to say that those 3 are witnesses in the U.S.'s prosecution of the matter?

If I am not mistaken, civil rights suits are usually federal suits.

You'd think by now, Nifong and his lawyers would know how to spell "lacrosse." In the bankruptcy filing (http://wral.com/asset/news/local/2008/01/15/2307322/Nifong_Bankruptcy_3.pdf), Nifong repeatedly write "LaCrosse" (74 times) while "lacrosse" is nowhere to be found. I've seen people use this odd capitalization soooo many times. What is wrong with people? How did this trend get started? I don't understand it....Someone enlighten me...

I doubt it affects you as a taxpayer. His creditors (auto loans, credit card bills, etc.) might be financially burdened, but his declaring bankruptcy has little impact on you. Even if he is found guilty in a civil case it is not like he was going to be able to write a check for $90 million. The tax liability to the residents of Durham or NC probably isn't impacted one way or another by his bankruptcy filing.

Some debts are not dischargeable in bankrupcy. I wonder what the status of a judgment against Nifong would be if his actions were found to be so opprobrius as to fall outside the realm of any colorable claim that he was acting within his statutory authority, and with a deliberate attempt to harm, etc. Perhaps such a judgment would not be dischargeable.

I remember putting forth the hope that Nifong's right to a pension could be forfeited if such a finding were made, but I seem to recall an expert about such matters said that NC law did not permit it.

A guy can hope, right?
