I just created a group for DBR. Join and write your posting name on the wall so we know who each other are. We can all just add each other as freinds from there.

I certainly support the effort, but we have to request that you change the name. "Duke Basketball Report" is a copyright of Duke Basketball Report, LLC, and should not be used without express permission.

Ok I will have to delete the group because Facebook does not allow the changing of group names once they have been created. Would something like "I read DBR" be ok. Or just "DBR"??

I can't speak for J&B, but so long as the title isn't so close that it could cause a third party to reasonably believe that the Duke Basketball Report is responsible for or endorses the content of the group, then it shouldn't be a problem.

I do not speak for J&B but I suspect that "Readers of DBR" or "Fans of DBR" or something like that would be fine.

You can't copyright a name. You copyright a creative work. You trademark a brand name. The USPTO doesn't show a registration for "Duke Basketball Report."

That said, we all like to treat this place as J&B would like us to, but with respect to this, we do it out of courtesy and appreciation, not legal rights.

That said, we all like to treat this place as J&B would like us to, but with respect to this, we do it out of courtesy and appreciation, not legal rights.
You're correct re copyright v. trademark, but it's a distinction without a difference for purposes of this thread. Also, you don't need to register a trademark with the PTO to enjoy protection. You don't even need to add "TM" to the end of it.

how about just the "Unofficial Duke Basketball Report Facebook Group" group?

that way its easy to search for.

or if someone makes it, just put a link on here.

What we don't need is 2 or 3 groups promoting the same thing, ie Friends of DBR, DBR Readers of the World, I Like DBR, etc. There's enough of that on facebook as it is.

There are also plenty of Duke Basketball fan pages and groups, but I agree that a DBR specific one would be good. An "official" group with blessings from up high would be nice.

The mods and owners have talked about this a bit over the past few months and, for now, there will not be an official DBR facebook group. If ya'll want to put something unofficial together, that is fine.

Seeing as there's a billion "I love Apple", "I hate the new Facebook", "I love Honda Cars", etc, on facebook, being unable to form a group saying "I love Duke Basketball Report" is a little bit narrow-minded.

Has anybody actually said that there can't be? I thought the problem was with naming a group "Duke Basketball Report" since people would assume that's an endorsed and official group.

Let's just keep it clean; we don't have a phalanx of lawyers following the legalistic minutiae. Please don't use "Duke Basketball Report" or "DukeBasketballReport.com" (or any similar variations) in any way without clearing it with Julio and Bos first.

In the future, we should also be careful and make sure that no one utters Duke Basketball Report in a newspaper, blog, or press release. To be absolutely safe, no one should utter Duke Basketball report in public, to friends, and to their families, lest they commit "copyright infringement".

I, for one, better contact my lawyer- in this post alone i have "infringed" on the "Duke Basketball Report" copyright five times!!!

Please. This is the real world.

The DBR has to pay a licensing fee to use the name "Duke". Part of that agreement is ensuring it's not misused.

We moderate here (perhaps to excess) to keep things rational. All we're asking is that you not use the DBR name as part of another site. Referencing (and linking) the DBR is fine, and even encouraged.

But we can't countenance creating a site in DBR's name. We just can't.

Simply mentioning a thing falls under the fair use exception to protected intellectual property. We couldn't stop it, nor would we try to.

Using the name in a manner that could confuse people and cause them to think Duke Basketball Report, LLC was responsible for or endorsed the content of another site, however, does not fall under fair use. If we failed to object to it, Duke Basketball Report, LLC could also lose the right to protect it's name from others in the future.

DBR's position isn't up for debate, absent a note from J&B. That's quite enough discussion on that particular aspect of the topic.

Oh Cavlaw, how mistaken you are! EVERYTHING on DBR must be debated! :rolleyes: Start a thread about the idea that we all need to be able to breathe and I'm sure you'll get some folks ready for a debate.
